GENERAL CONDITIONS OF CONTRACT
This contractual document will govern the contracting of products and services through the website www. mypugandco. com, owned by MY PUG PETSUPPLIES, S. L provided with CIF number B09770538, address at C/ PINTOR MIR 7, 3-1, 08031, Barcelona, with email guau@mypugandco. com (hereinafter, the PROVIDER).
The acceptance of this document implies that the USER:
- You have read, understand and comprehend what is stated here.
- He is a person with sufficient capacity to contract.
- Assumes all obligations set forth herein.
These conditions will have an indefinite period of validity and will be applicable to all contracts made through the website www. mypugandco. com
OBJECT OF THE CONTRACT
The purpose of this contract is to regulate the contractual relationship of sale between the PROVIDER and the USER.
1. GENERAL CONTRACT CLAUSES
Unless specifically stipulated in writing, placing an order with the PROVIDER will imply acceptance by the USER of these legal conditions.
No stipulation made by the USER may differ from those of the PROVIDER if it has not been expressly accepted in advance and in writing by the PROVIDER.
These Conditions, together with the Privacy Policy and the Legal Notice of the Website, are the only conditions applicable to the use of the Website and the purchase of products through it and replace any other conditions.
Consequently, the User who accesses the Website and makes the purchase of products through the Website agrees to submit to and is bound by these Conditions, the Privacy Policy and Legal Notice as they are written at the time access to the Website.
Every User who registers to the Website must be at least eighteen (18) years old.
2. SENDING ORDERS
Shipments are made by courier service.
Shipping costs include in all cases the Value Added Tax (VAT), but no other taxes, duties, customs, tariffs or surcharges.
The PROVIDER delivers the orders to the courier service within a period of approximately 48 working hours. The PROVIDER is not responsible for possible delivery delays caused by the courier service.
The PROVIDER will not send any order until it has verified that the payment has been made by the USER.
Shipments to Spain (peninsula) take approximately 24-48 working hours (Monday to Friday) once the payment has been confirmed by the USER.
In international shipments, the delivery time can be from 4 to 10 working days (Monday to Friday), depending on the destination and the indicated transport company.
Once the package is delivered to the courier service, the USER will receive an SMS or email with the shipment tracking number. The PROVIDER will not assume any responsibility when the delivery of the product or service is not carried out, because the data provided by the USER is false, inaccurate or incomplete. In these cases, the PROVIDER will reimburse the price of the products, but not the corresponding shipping costs.
In the event that the USER wishes to return the products voluntarily, that is, without detecting defects or irregularities in them, the customer will be reimbursed the amount of the returned products minus the return costs (3 €70).
The delivery will be considered made at the moment in which the carrier has made the products available to the USER and the USER, or his delegate, has signed the delivery receipt document.
3. RIGHT OF WITHDRAWAL
The USER will have a minimum period of fourteen calendar days to withdraw, from the day the customer receives the product, without any penalty and without indicating the reasons.

Unless the return is made due to defects in the product, the PROVIDER will reimburse the customer for the amount of the returned product less the return costs. The product must be returned in its original packaging and in perfect condition.
Under no circumstances may changes and/or returns of purchases of personalized products be made.
The right of withdrawal may not be applied in the following cases:
- 1. If the product is not presented in perfect condition.
- 2. If the product packaging is not original or it is not in perfect condition.
- 3. When the product is open without being able to demonstrate that it has not been used.
- 4. When they are personalized products.
The user will not be able to cancel an order once it has been confirmed.
4. CLAIMS

5. RIGHT NOT TO ACCEPT AN ORDER
The PROVIDER may cancel any confirmed order or not accept an order placed, for the following reasons:
- In case of a technical error and/or a typographical error in the prices or in the rest of the data of the products contained in the Website when the order was placed.
- Due to lack of availability.
- When security systems indicate that the order may be fraudulent.
- When there are reasons indicating that the customer is a minor.
- When the PROVIDER has not been able to deliver the order to the address provided by the customer.
- If there is a computer attack, virus or any event that is beyond reasonable control (force majeure).
- In case of a payment error.
In such cases, the PROVIDER will fully reimburse the amounts that have been paid.
6. FORCE MAJEURE
In the event that, due to circumstances of force majeure, a product is not available after the purchase has been made, the PROVIDER will inform the User by email of the total cancellation.
The PROVIDER is not responsible for delays in the delivery of orders, or the impossibility of carrying them out when the cause is due to an event of force majeure, and therefore, beyond our control. Among other causes, we understand that force majeure exists in the following cases, but without limitation: accidents; strikes; riots, threats or terrorist attacks; fire or explosion; meteorological causes or natural disasters such as storm, flood, earthquake, subsidence, epidemic; problems beyond our control in means of transport or telecommunication systems.
To the extent possible, once the cause of impossibility or delay has ended, the PROVIDER will do everything possible to resume its commercial activities and be able to comply with its obligations and shipments.
7. COMPETITION
The USER may not assign, transfer or transmit the rights, responsibilities and obligations contracted in the sale.
If any stipulation of these conditions is considered null or impossible to comply with, the validity, legality and compliance of the rest will not be affected in any way, nor will they be modified in any way.
The USER declares to have read, understood and accepted these General Conditions in their entirety.
8. GENERALITIES OF THE OFFER
All sales and deliveries made by the PROVIDER shall be understood to be subject to these General Conditions.
9. PRICE AND VALIDITY TERM OF THE OFFER
The prices indicated for each product include Value Added Tax (VAT) or other taxes that may be applicable. These prices, unless expressly stated otherwise, do not include shipping, handling, packaging, shipping insurance or any other additional services attached to the product or service purchased.
The prices applicable to each product are those published on the website and will be expressed in the EURO currency. THE USER assumes that the economic valuation of some of the products may vary in real time.

11. FORMS OF PAYMENT, CHARGES AND DISCOUNTS
The forms of payment accepted are:
1. PAYPAL:
The USER will be taken to the PayPal website, taking advantage of its secure payment platform. Once the payment process has been completed, you will be redirected back to the PROVIDER's website. Once in PayPal you can make the payment with a Paypal account or with a credit card, in no case is cash on delivery accepted through the Paypal website.
Paypal may withhold an amount as a deposit or insurance when attempting to make a purchase with the card on the PayPal platform. The collection of this amount does not guarantee that the purchase is made.
2. VISA, VISA OR MASTERCARD CREDIT or DEBIT CARD.
All operations involving the transmission of personal or banking data are carried out using a secure environment, a server based on standard security technology SSL (Secure Sockets Layer).
All the information you transmit to us travels encrypted through the network. Likewise, the data on your credit card are entered directly on the bank's page, in the POS (Point of Sale Terminal of the Bank) and are not entered or registered in any server of the PROVIDER.
When paying with a VISA or MASTERCARD card, the following information will always be requested: the card number, the expiration date, and a Validation Code that matches the last three digits of the number printed in italics on the back of your card. VISA or MASTERCARD card, thus offering more guarantees regarding the security of the transaction.
12. APPLICABLE WARRANTIES
All our products enjoy the commercial guarantee of their supplier. Therefore, if the product is defective, it will be the PROVIDER who is in charge of collecting it and exchanging it for the correct one, taking charge of the costs associated with this return and exchange.
In order to manage the incident we need you to notify us by email to guau@mypugandco. com indicating:
The reason for the incident, the order number, (essential to locate the purchase), the delivery note and photos of the damaged or erroneous product so that we can assess the situation. To exercise the guarantee right, you must have proof of purchase or delivery note.
It is important for you to know that our guarantee does not cover:
- a) The negligent or violent use of the product.
- b) Damages derived from handling or intervention of the product.
13. RETURNS
The first peninsular return for size change is free.
In the return for exchange of product or refund of money the customer will be charged the shipping costs of the return.
During Black Friday offers, 3x2 Special Offer, Sales Season, or Discounted Products, the return costs will be borne by the buyer, with an amount of €4.95 in case of size/product change and €3.70 if you request a refund of the money.
In any case, the products to be returned must be in perfect condition, unused and in their original packaging. Therefore, to avoid transport problems, please ensure that the package is duly protected and sealed. Once received, we will check their status. As soon as we verify that both the item(s), as well as the possible components, accessories, promotional gifts and documentation, are complete and in perfect condition, we will proceed to return the money paid for the products purchased or send the new product by which the return is made.

14. APPLICABLE LAW AND JURISDICTION
Likewise, the PROVIDER reserves the right to present civil or criminal actions that it deems appropriate for the improper use of its website and contents or for breach of these conditions.
The relationship between the USER and the PROVIDER will be governed by the regulations in force and applicable in Spanish territory. If any controversy arises, the parties may submit their conflicts to arbitration or go to the ordinary jurisdiction, complying with the rules on jurisdiction and competence in this regard. The PROVIDER is domiciled in BARCELONA, Spain.
Products with a discount on their original price
Products with a discount on their original price are all those products purchased with discount codes, with a catalog discount on their original price during the period of time indicated above.
Changes
On these products, only 1 change will be accepted for another size (indistinctly larger or smaller) of the same product purchased or of a different product, it is not possible to make more than one change on the same product. If it is not possible to make the requested change in size, for any reason of our own or others, the product will be returned in exchange for the final amount paid for the product, excluding the amount paid for "Shipping". The exchange period for these products will be 14 calendar days from the date of receipt of the order. In order to be exchanged, the product must be in perfect condition (unused) and keep its original packaging.
